Terms of Service of the Sola project

PLEASE READ CAREFULLY THESE TERMS OF SERVICE OF THE SOLA PROJECT (HEREINAFTER “AGREEMENT” OR “TERMS OF SERVICE”) BEFORE USING THE SOLA PROJECT AS THEY AFFECT YOUR OBLIGATIONS AND LEGAL RIGHTS, INCLUDING, BUT NOT LIMITED TO WAIVERS OF RIGHTS AND LIMITATION OF LIABILITY. BY USING AND ACCESSING THE SOLA PROJECT, YOU AGREE TO BECOME BOUND BY ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE WITH THIS AGREEMENT, DO NOT ACCESS OR USE THE SOLA PROJECT. THE SOLA PROJECT IS ACCESSED BY YOU (EITHER AN INDIVIDUAL OR LEGAL ENTITY, HEREINAFTER “USER ” OR “YOU”) UNDER THE FOLLOWING TERMS AND CONDITIONS:

The Sola project (or Sola), available in the Internet via https://sola.ai/, owned and operated by PLAG Limited, a company incorporated at Drake Chambers, Road town, Tortola, P.O.BOX 3321, British Virgin Islands is a social platform for virtual interaction between users. "Services" refers to your use of Sola project for any purpose whatsoever.

This agreement was written in English. To the extent any translated version of this agreement conflicts with the English version, the English version shall prevail. In the Agreement, unless the opposite is clear from the context:

1) words in the singular shall include the plural and in the plural shall include the singular;

2) a reference to one gender shall include a reference to the other genders;

3) reference to any party shall include that party’s personal representatives, successors and permitted assigns.

4) all references to a person include firms, companies, government entities, trusts and partnerships or other or unincorporated body (whether or not having separate legal personality);

5) the term 'including' does not exclude anything not listed;

6) a reference to writing or written includes fax and e-mail.

7) any obligation on a party not to do something includes an obligation not to allow that thing to be done.

8) headings of sections are for convenience only and shall not be used to limit or construe such sections.

1. STATUS OF THE AGREEMENT

1.1. This Agreement is developed by PLAG Limited and determine the terms and conditions of use of Sola project, rights and obligations of its Users.

1.2. This Agreement constitute a legally binding agreement between the User and PLAG Limited that is a company incorporated in Drake Chambers, Road town, Tortola, P.O.BOX 3321, British Virgin Islands (hereinafter, the “Company” or “PLAG”) the owner of the Sola project available in the Internet via https://sola.ai/ whereby the Company provides services for the User regarding the use of the Sola project and its Services.

1.3. This Agreement is intended to fully reflect the terms of the original agreement between the parties. By proceeding Sola Project you agree with this Agreement. No provision of the Agreement shall be considered waived unless such waiver is accepted by the party that benefits from the enforcement of such provision by action of a click in a specific check box with the text “I agree”, which shall be published on the Sola Project website in such case. No waiver of any provision in the Agreement, however, will be deemed a waiver of a subsequent breach of such provision or a waiver of a similar provision. In addition, a waiver of any breach or a failure to enforce any term or condition of the Agreement will not in any way affect, limit, or waive a party’s rights hereunder at any time to enforce strict compliance thereafter with every term and condition hereof.

1.4. If any term, provision, covenant or restriction of this Agreement is held by a court or arbitration of competent jurisdiction to be invalid, illegal, void or unenforceable, the remainder of the Agreement, provisions, covenants and restrictions set forth herein shall remain in full force and effect and shall in no way be affected, impaired or invalidated, and the parties hereto shall use their commercially reasonable efforts to find and employ an alternative means to achieve the same or substantially the same result as that contemplated by such term, provision, covenant or restriction. It is hereby stipulated and declared to be the intention of the parties that they would have executed the remaining Agreement, provisions, covenants and restrictions without including any of such that may be hereafter declared invalid, illegal, void or unenforceable.

1.5. The Company may make changes and/or additions to this Agreement unilaterally without any special notification. These Terms of use are an open document accessible to the general public. The current version of the Terms is available on the Internet at https://sola.ai/. The Company recommends that the Users check the conditions of this Agreement regularly for changes and/or additions. The continuation of use of the Sola after changes and/or additions are made to these Terms of use will mean the User’s agreement with and acceptance of such changes and/or additions.

1.6. The Company may change suspend or discontinue the Sola project and its Services at any time, including the availability of any feature, database, or Content.

2. ACCEPTANCE OF THE TERMS

2.1. These Terms of use are accepted by you when you access to the Sola project website and use the Services. You may print a copy of these Terms for your records and we highly recommend you do so. These Terms remain effective from the date of acceptance until terminated by You or Company in accordance with this Agreement.

2.2. You cannot accept this Agreement if:
(a) you are not lawfully entitled to use the Services under any applicable laws in the country in which you are located or resident; or
(b) if you are not of legal age to form a binding agreement with Company.

2.3. By accepting this Agreement you acknowledge and agree that you have reached the age to enter into such binding agreement in the country in which you are located or resident or that you have your parent or legal guardian's permission if required by applicable law. It is your responsibility to ensure that you are legally allowed to enter into this Agreement and that you do not violate any applicable laws.

2.4. In some countries there exist legal and/or other restrictions on usage of the Services and/or downloading, installing and/or using of products, portions of products, software which are or might be available through the Services. It is your responsibility to ensure that you comply with all applicable legal restrictions in your jurisdiction.

Publishing any content on Sola project website, including personal information the User understands and accepts that this information may be available to other Internet users taking into account the architecture and functionality of the Sola.

OBLIGATIONS OF THE USER

3.1. User is responsible for all of its activity in connection with the Services and accessing the Sola. Any fraudulent, abusive, or otherwise illegal activity or any use of the Services or content in violation of this Agreement may be grounds for termination of User’s right to Services or to access the Sola project.

3.2. When using the Sola project the User is obliged:

— To comply with the provisions of this Agreement and other special documents of Sola project;

— Not to post such information and objects (including links thereto) which may infringe the rights and interests of other persons;

— Before posting information and objects (including but limited to other people’s images, texts of various content, audio records and videos), to assess in advance whether such posting is lawful;

— To keep confidential and not to disclose to other Users and third parties the personal data which became known to him/her as the result of communication with other Users and other use of the Sola project (including but not limited to home addresses, phone numbers, e-mail, messenger’s addresses, social network’s profiles, passport details, banking information) and information on the private life of other users and third parties without the appropriate prior permission of the latter;

4. CONTENT

4.1. Company has established the rules set forth below with respect to Content. Please note that these rules do not create any third party rights or create any private right of action, but may be enforced solely by PLAG Limited in its sole discretion.

4.2. PLAG Limited may review any Content. The decision by Company does not take action to enforce these rules in a particular instance will not be considered a waiver of any right to do so in the future or in other situations.

4.3. When using the Sola project the User is restricted from uploading any content related to:

— Impersonalization: You may not impersonate others through the Sola project in a manner that does or is intended to mislead, confuse, or deceive others.

— Private Information: Respect the rights of other users.

— You may not publish or post other people's private and confidential information, such as credit card numbers, phone numbers, street address or Social Security/National Identity numbers, real names and other personal data without their express authorization and permission.

— You may not post intimate photos or videos that were taken or distributed without the subject's consent.

— You may not post, comment, or store content that violates or infringes someone else's rights of publicity, privacy, copyright, trademark, or other intellectual-property right, bullies, harasses, or intimidates, defames, spams or solicits Sola's users.

— Violence and Threats: You may not publish or post direct, specific threats of violence against others.

— Unlawful Use: You may not use our service for any unlawful purposes or in furtherance of illegal activities. International users agree to comply with all local laws regarding online conduct and acceptable Content.

— Misuse of Sola Badges: You may not use badges such as but not limited to the Promoted or Verified Sola project badge, unless provided by the Sola project. Accounts using these badges in a way that falsely implies affiliation with the Sola project may be suspended.

— Intellectual Property: You may not upload, publish, post, distribute or disseminate any Content that is protected by intellectual property laws (or by rights of privacy and/or publicity) unless you own or control the rights thereto or have received all necessary consents

4.4. PLAG Limited strives to protect its users from abuse and spam. User abuse and technical abuse are not tolerated on Sola project and may result in permanent suspension. Any accounts engaging in the activities specified below may be subject to permanent suspension.

— Serial Accounts: You may not create multiple accounts for disruptive or abusive purposes or with overlapping use cases. Mass account creation may result in suspension of all related accounts. Please note that any violation of the Sola project rules is cause for permanent suspension of all accounts.

— Targeted Abuse: You may not engage in targeted abuse or harassment. If the reported behavior is one-sided or includes threats it is considered as targeted abuse or harassment.

— Selling Accounts: You may not buy or sell Sola project accounts.

— Malware/Phishing: You may not publish or link to malicious Content intended to damage or disrupt another user’s browser or phone or to compromise a user’s privacy.

— Sensitive Content: You may not use the Sola project to spread sensitive content. Some of the factors that we take into account when determining what content is considered sensitive are:

— Content which includes an excessive consumption of alcohol or illegal substances, or encourages minors to consume alcohol or smoke cigarettes;

— Content which is portraying realistic images of people or animals being killed or maimed, shot, stabbed, tortured or injured, or links to such content;

— Content or comments that depict violence against or abuse of children;

— Content that includes realistic depictions of weapons in such a way as to encourage illegal or reckless use of such weapons;

— Content that present excessively objectionable or crude content;

— Content that promotes or contains pornographic material; this includes sexually explicit or erotic content, icons, titles, comments or descriptions and/or can be deemed as pornographic and/or obscene by the Sola project; the Sola project has a zero-tolerance policy against child sexual abuse imagery.

— Posts and comments may contain or quote-religious text provided the quotes or translations are accurate and not misleading. Commentary should be educational or informative rather than inflammatory;

— Content or comments that contain references or commentary about a religious, cultural or ethnic group that are defamatory, offensive, mean-spirited or likely to expose the targeted group to harm or violence;

— Spam: You may not use the Sola project for the purpose of spamming anyone. The exact definition of “spamming” will evolve as we respond to new tricks and tactics by spammers. Some of the factors that we take into account when determining what conduct is considered to be spamming are:

— If a large number of complaints have been filed against you;

— If you post multiple duplicate updates (text, links, images, videos);

— If you send large numbers of duplicate comments;

— If you repeatedly create false or misleading content;

— If you repeatedly post other users' account information as your own (bio, cards, etc.);

— If you post misleading links (e.g. affiliate links, links to malware/click jacking pages, etc.);

— Creating misleading accounts or account interactions;

— Graphic Content: You may not use pornographic or excessively violent media in your profile image, header image, or background image.

4.5. We reserve the right to remove or modify user Content for any reason without prior notice, at Company sole discretion, and without liability to the user, including user Content that we believe violates these Terms or our policies. In appropriate circumstances, Company will also terminate a user’s account if the user is determined to be a repeat infringer.

4.6. Your use of the Services and all Content you posted on, transmitted through or linked from the Sola project and/or the mobile applications is in compliance with the rules set forth in these Terms and all applicable local, state, national, and international laws, rules and regulations, including any laws regarding the transmission of technical data exported from your country of residence and all export control laws.

4.7. By using the Sola project and/or the Services, you acknowledge and agree that:

All content that You have transmitted through the Sola project, is your sole responsibility.

4.8. Under no circumstances will PLAG Limited be liable in any way for any content or for any loss or damage of any kind incurred as a result of the use of any content, emailed or otherwise made available via the Sola project and/or the Service.

If you post any comments or content to the Sola project, unless we indicate otherwise, you grant PLAG Limited and its affiliates a nonexclusive, royalty-free, perpetual, irrevocable and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such content in connection with: providing and promoting the Services; and/or exercising the rights granted in these Terms of service.

5. VIRTUAL CURRENCY

5.1. Sola project uses virtual currencies: AT and SOL. AT is a based virtual currency and used for creating posts, comments and vote for quality content. SOL is a derivative of AP which was transferred by voting.

5.2. Users can earn AT by:

—  Daily bonus  

—  Usage the app, watch posts and comments  

—  Referral program

5.3. Users can spend AT by:

—  Create post

—  Create comment

—  Vote for post or comment

5.4. Users can earn SOL by:

— Get voice from another users for content or comment. AP , used by users for votes, converts to SOL on creators balance.  

5.5. Users can spend SOL by:

—  Buy goods or service on Sola project.

5.6. Virtual currencies SOL and AP have no monetary value and do not constitute currency or property, do not represent or constitute any ownership right or stake, share or security or equivalent rights or any right to receive future revenue shares, or any other form of participation in or relating to. SOL and AP are non-refundable. You are not entitled to a refund for any unused virtual currency.

6. SECURITY

6.1. Use of the Sola or Services to violate the security of any computer network, crack passwords or security encryption codes, transfer or store illegal material including that are deemed threatening or obscene, or engage in any kind of illegal activity is expressly prohibited.

6.2. Under no circumstances will User use the Sola or the Service to:
(a) send unsolicited e-mails, bulk mail, spam or other materials to users of the Sola or any other individual,
(b) harass, threaten, stalk or abuse any person or party, including other users of the Sola,
(c) create a false identity or to impersonate another person, or
(d) post any false, inaccurate or incomplete content or delete or revise any content that was not posted by You.

6.3. The Company may take reasonably security precautions when using the internet, telephone or other means to transport date or other communications, but expressly disclaims any and all liability for the accessing of any such data communications by unauthorized persons or entities.

7. FRAUD

7.1. Company strives to protect its users from unfair actions. Fraud and technical abuse are not tolerated on Sola project and may result in permanent suspension. Any accounts engaging in the activities specified below may be subject to permanent suspension.

(a) Serial accounts. You may not create multiple accounts for fraud or unfair purposes or with overlapping use cases. Mass account creation may result in suspension of all related accounts. Please note that any violation of the Sola project rules is cause for permanent suspension of all accounts.

(b) Unfair votes. Only fair votes by interested users are considered qualitative by Sola. You may not use any third party software or services or other resources to falsify the amount of votes on your or other users’ posts. You may not incentivize users in any way to vote on your card both inside or outside Sola. You may not ask for endorsements or interfere in the natural way of spread algorithm. Collusion with other users to endorse cards each other is prohibited and can be lead to block all involved parties. All means and methods that artificially increase or otherwise change the number of votes are prohibited without exception.

(c) Special software and services. Prohibited using software, as well as other tools  for automatically browse's purpose and to force the user to vote.

7.2. All votes and browses made by the user with rules violations are considered as low-quality. All SOL accrued to users for low-quality votes are withdrawn from the account of such users and returned to the affected users of the Sola project. Violation of the material provisions of these Terms, namely the artificial increase or change in the number of votes or browses, may lead to the user's warning of the violation of the Terms, as well as termination of relations and closure of the user's account in the Sola project for all time.

8. THIRD PARTY WEBSITES

8.1. Users of the Sola Project may gain access from the Sola to third party websites on the Internet through hypertext or other computer links on the Sola. Third party websites are not within the supervision or control of the Company or the Sola. Unless explicitly otherwise provided, neither the Company nor the Sola make any representation or warranty whatsoever about any third party Sola that is linked to the Sola project, or endorse the products or services offered on such Sola. The Company and the Sola project disclaim: (a) all responsibility and liability for content on third party websites and (b) any representations or warranties as to the security of any information (including, without limitation, credit card and other personal information) User might be requested to give any third party, and User hereby irrevocably waive any claim against the Sola project or the Company with respect to such websites and third party content.

9. PRIVACY

9.1. Please review our Privacy Policy, which governs the use of personal information on the Sola and to which User agrees to be bound.

9.2. The Company process your personal information, the traffic data and the content of Your communication(s) in accordance with our Privacy policy.

  1. INTELLECTUAL PROPERTY

10.1. Exclusive rights in the Sola Content:

(a) All objects placed on the Sola project, including design elements, text, graphic images, illustrations, videos, scripts, software, music, sounds and other objects and their collections (hereinafter the Content) are subject to exclusive rights of the Plag Limited, Users and other rights holders, all rights in these objects being reserved.

(b) Except as provided by these Terms of service as well as by effective legislation, no Content may be copied (reproduced), processed, distributed, displayed in the frame, published, downloaded, transferred, sold or otherwise used in full or in part without the prior permission of the right owner, unless the right owner has expressly agreed to free use of the Content by any person. Reproducing, copying, collecting, systemizing, storing and transferring the Content in order to create a database whether for commercial and/or non-commercial purpose and/or using the Content in whole or its part regardless of the way of use is not allowed without the Company’s consent.

(c) By posting on the Sola project his/her lawfully owned Content, the User grants the other Users a non-exclusive right to use it in the framework of the functional provided by the Sola by viewing, reproducing (including copying) and other rights exclusively for the purpose of personal non-commercial use, except where such use infringes or may infringe the right owner’s interests protected by law.

(d) The Content made available exclusively for the purpose of personal non-commercial use may be used by the User on the condition that all copyright marks or other authorship notices, name of the author and the work remain unchanged.

(e) The User grants to the Company a non-exclusive right to use on a free of charge basis the Content published on the Sola and which lawfully belongs to him/her, so that the Company may maintain the operation of the Sola project in the amount established by its architecture and functionality, and to use this Content for the Sola promotional content, including images of the Sola interface, including without limitation making this promotional content public. The said non-exclusive right is granted for the period when the Content is placed on the Sola and extends to the territory of the countries all over the world. The end of the period when the Content is placed on the Sola and /or the end of the non-exclusive right duration do not carry a necessity of deletion by the Company of this promotional content with the said Content (including its removal from the Internet). The Company has a right to transfer these rights described in this clause to the third-parties. The User accepts that the Company has a right to use functional and technical capabilities of the Sola that provide displaying of the published Content by the User, including player, meant to display the Content at its own discretion, including for the purpose of showing the advertising information.

(f) If the User deletes his/her Content from the Sola, the non-exclusive right mentioned in clause (f) hereof will be automatically revoked, however, the Company reserves the right to keep backup copies of the User’s Content during the required period of time, if needed due to technical peculiarities of the Sola operation.

(h) Except his/her own Content, the User does not have the right to upload or otherwise make available to the public (publish on the Sola) the content of other websites, databases and other intellectual activity results without the express consent of the right owner.

(i) Any use of the Sola or Content, except as permitted herein or except the right owner consents to such use in writing, without the prior written permission of the right owner is categorically prohibited.

(j) Unless otherwise expressly provided in this Agreement, nothing in this Agreement may be considered as the grant of exclusive rights in the Content.

10.2. Liability for the infringement of exclusive rights:

  1. The User bears personal liability for any Content or other information he/she uploads or otherwise makes publicly available (publishes) on or via the Sola. The User does not have the right to upload, transfer or publish Content on the Sola unless he/she has appropriate rights to do so, such rights being acquired by or transferred to him/her in accordance with relevant legislation.
  2. The Company has the right but is not obliged to check the Sola project for prohibited Content and can delete or remove (without giving advance notice) any Content or Users at its own discretion for any reason or without reason, including, without limitation, removal or deletion of the Content which, in the personal opinion of the Company, infringes these Terms of service, applicable law and/or may infringe the rights of, cause damage to, or threaten the security of other Users or third parties.
  3. By posting his/her Content on the Sola project, the User grants the Company the right to copy his/her Content in order to streamline and facilitate the publication and storage of the user Content on the Sola.
  4. By posting his/her Content in any part of the Sola, the User automatically grants the Company free of charge the non-exclusive right to use it by copying, public performance, reproduction, processing, translation and distribution for or in connection with the purposes of the Sola, including for the purpose of increasing its popularity. For these purposes, the Company may produce derivative works or insert the User’s Content as components in relevant collections or take other actions for these purposes.
  5. In case the User removes his/her Content from the Sola, the rights mentioned in clauses (c) and (d) hereof will be automatically cancelled; however, the Company has the right to keep archive copies of the user Content for an indefinite period.

11. LIMITED LICENSE

11.1. We grant to the end User a limited, non-sublicensable, non-exclusive and revocable license to access and make use of the Sola project, the Mobile applications and the Materials solely in accordance with, and subject to, these Terms and any other of our policies as said on the Sola project.

11.2. Except as otherwise expressly permitted by these Terms, you may not:

collect, use, copy or distribute any portion of the Sola project or the Materials; resell, publicly perform or publicly display any portion of the Materials; modify or otherwise make any derivative uses of any portion of the Sola project, the Mobile applications or the Materials; use any "deep-link," "page-scrape," "robot," "spider" or other automatic device, program, algorithm or methodology which perform similar functions to access, acquire, copy, or monitor any portion of the Sola project; use Sola project in a manner which results in the depletion of Web Sola infrastructural resources; download (other than page caching) any portion of the Sola project, the Materials or any information contained therein or use the Sola project or the Materials other than for their intended purposes.

12. TAXES

12.1. It is your responsibility to determine what, if any, taxes apply to the transactions you for which you have submitted transaction details via the Sola project, and it is your responsibility to report and remit the correct tax to the appropriate tax authority. You agree that Plag Limited is not responsible for determining whether taxes apply to your Sola project transactions or for collecting, reporting, withholding or remitting any taxes arising from any Sola project transactions.    

13. NOTICES AND CLAIMS

13.1. Company may give notice of a claim of copyright infringement to our users by means of a general notice on the Services, electronic mail to a user's email address in our records, or by written communication sent by mail. In accordance with the applicable law, Company has adopted a policy of terminating, in appropriate circumstances and at the sole discretion of Company, account holders who are deemed to be repeat infringers. Company may also at its sole discretion limit access to the Services of the Sola project and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

13.2. If you believe that anything on the Services infringes upon any copyright which you own or control, you may send a notification of such infringement.

14. APPLICABLE LAW AND DISPUTE RESOLUTION

14.1. This Agreement shall be governed by and interpreted in accordance with the laws of England and Wales without regard to its conflict of laws provisions. The exclusive jurisdiction and venue of any action with respect to the subject matter of this Agreement shall be the relevant courts in London, United Kingdom, and each of the parties hereto waives any objection to jurisdiction and venue in such courts. However, we reserve the right to seek injunctive relief in any jurisdiction when we deem it necessary.

15. IDEMNITY

15.1. User will indemnify and hold PLAG Limited, its directors, officers and employees, harmless, including costs and attorneys' fees, from any claim or demand made by any third party due to or arising out of User’s access to the Sola, use of the Services, the violation of this Agreement by User, or the infringement by User, or any third party using the User’s account, of any intellectual property or other right of any person or entity.

16. TERMINATION OF THE TERMS

16.1. You may terminate relationship with PLAG Limited at any time by closing your Sola project account, or otherwise ceasing to use the Services. You acknowledge and agree that by terminating your relationship with PLAG in the way stipulated in this section you will lose all access to your Sola project account and it no longer be available to you. We will not be responsible and will not have any obligation to restore and/or reinstate your Sola project account or any data lost. All virtual currencies such as AP and SOL will be deleted from your Sola project account and cannot be restored.

16.2. Without limiting other remedies, Sola project may suspend or terminate this Terms with you, or may terminate or suspend your use of the Services at any time if:

(a) you are in default of these Terms;

(b) you are engaged in illegal actions, or infringe proprietary rights, rights of privacy, or intellectual property rights of any person, or any third party rights, or otherwise create risk or possible legal exposure for us;

(c) required by applicable laws/regulations and within the time limits as required by such laws/regulations;

(d) we decide to cease offering the Services generally.

16.3. Upon termination of this Terms: (a) all licenses and rights to use the Services shall immediately terminate; (b) you will immediately cease any and all use of the Services.

16.4. Any suspension or termination of this Terms will not affect your obligations to PLAG under these Terms (including, without limitation, proprietary rights and ownership, indemnification and limitation of liability, confidentiality), which reasonably are intended to survive such suspension or termination. We reserve the right to change or modify any provisions of these Terms or guidelines governing your use of the Services, at any time in our sole discretion and without liability to users. Any such changes or modifications will be effective immediately upon posting of revisions on the Sola project. Your continued use of the Services following the posting of such changes or modifications constitutes your acceptance of the Terms. Therefore, you should frequently review these Terms or guidelines on the Sola project in order to understand the terms and conditions applicable to your use of the Services. If you do not agree to any changes or modifications to these Terms or to any applicable policies or guidelines, your sole recourse is to stop using the Services.

17. EXCLUSION OF WARRANTIES, LIMITATION OF LIABILITY AND INDEMNITY

17.1. No Warranties: TO THE MAXIMUM EXTENT PERMITTED BY LAW: THE SERVICES PROVIDED ON "AS IS" AND “AS AVAILABLE” BASIS, AND USED AT YOUR SOLE RISK WITH NO WARRANTIES WHATSOEVER; COMPANY DOES NOT MAKE ANY WARRANTIES, CLAIMS OR REPRESENTATIONS AND EXPRESSLY DISCLAIMS ALL SUCH WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, WITH RESPECT TO THE SERVICES INCLUDING, WITHOUT LIMITATION, WARRANTIES OR CONDITIONS OF QUALITY, PERFORMANCE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR USE FOR A PARTICULAR PURPOSE. PLAG FURTHER DOES NOT REPRESENT OR WARRANT THAT THE SERVICES WILL ALWAYS BE AVAILABLE, ACCESSIBLE, UNINTERRUPTED, TIMELY, SECURE, ACCURATE, COMPLETE AND ERROR-FREE OR WILL OPERATE WITHOUT PACKET LOSS, NOR DOES PLAG WARRANT ANY CONNECTION TO OR TRANSMISSION FROM THE INTERNET.

No Liability: YOU ACKNOWLEDGE AND AGREE THAT PLAG SHALL HAVE NO LIABILITY WHATSOEVER, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER THEORY OF LIABILITY, AND WHETHER OR NOT THE POSSIBILITY OF SUCH DAMAGES OR LOSSES HAS BEEN NOTIFIED TO PLAG , IN CONNECTION WITH OR ARISING FROM YOUR USE OF THE SERVICES PROVIDED TO YOU THROUGH Sola project. YOUR ONLY RIGHT OR REMEDY WITH RESPECT TO ANY PROBLEMS OR DISSATISFACTION WITH SUCH SERVICES IS TO IMMEDIATELY CEASE USE OF SERVICES.

FURTHERMORE, YOU ACKNOWLEDGE AND AGREE THAT NEITHER PLAG NOR ANYONE ELSE WHO HAS BEEN INVOLVED IN THE CREATION, PRODUCTION OR DELIVERY OF THE SERVICES shall be liable to you, whether in contract, tort (including negligence) or any other theory of liability, and whether or not the possibility of such damages or losses has been notified to PLAG Limited, for (a) any indirect, special, incidental or consequential damages; or (b) any loss of income, business, actual or anticipated profits, opportunity, goodwill or reputation (whether direct or indirect); or (c) any damage to or corruption of data (whether direct or indirect)
